Green Card for Professionals and Employees

It is possible to obtain an immigrant visa (Green Card) through an offer of employment. Arrufat Gracia can help you asses if you or your employee qualifies for a green card and under any of the following categories:

First Preference: EB-1 Visa for Priority Workers

  • Workers of extraordinary ability in the sciences, arts, education, business or athletics
  • Outstanding professors or researchers
  • Multinational managers or executives

Second Preference: EB-2 National Interest Waiver; Visa for Professionals with Advanced Degrees or Exceptional Ability in the sciences, arts or business

  • Advanced degree professionals.
  • Workers who because of their exceptional ability in the sciences, arts, or business will substantially benefit prospectively the national economy, cultural or educational interests, or welfare of the United States
  • National Interest Waivers
  • Schedule A workers under Section 656.22 of 20CFR

Third Preference: EB-3 Visa for Skilled Workers, Professionals and other Workers Professionals with bachelor’s degrees

  • Skilled workers
  • Other workers (less than two years’ experience required for the position)

Fourth Preference: EB-4 Visa for “Special” Immigrants

  • Religious workers

Fifth Preference: EB-5 Visa for Investors

  • Investors of at least $1,000,000, or
  • Investors of at least $500,000 if the investment is being made in a “targeted employment area,” which is an area that has experienced unemployment of at least 150 per cent of the national average rate or a rural area as designated by OMB

These petitions must be filed with USCIS using the Form I-140 at the appropriate USCIS Regional Service Center including the required fees and supporting evidence. An I-140 needs to be approved in order to be eligible for the green card application.
